Because I have seen many people spend a lot of time, energy, and money on traditional divorce cases, I recommend a collaborative law approach as an excellent, cost effective alternative to traditional litigated divorce, especially for empty nest divorces. If you are interested in learning more about collaborative divorce, please continue reading, or send me an email to discuss your situation.

On average, most divorces happen between ages 45-54. However, Empty Nest Divorces are on the rise because older people want to have a fulfilling, rewarding, and joyful next chapter.

Empty Nest Divorce: Empty nest syndrome is the label for feelings of sadness, grief, and loneliness that many parents experience when their children move out. Many people who stayed together just “for the kids” are deciding to get a collaborative divorce now that the kids have launched. Empty Nest Divorces are on the rise.

Why are empty next divorces on the rise? Nearly half of all marriages in the United States end in a divorce or separation, but baby boomers and gen x are divorcing at a higher rate than ever before.

We’ve watched many older celebrity couples divorce or separate, including Bill & Melinda Gates, Kevin Costner & Christine Baumgartner, Hugh Jackman & Deborra-Lee Furness, Reese Witherspoon & Jim Toth, and Canadian Prime Minister Justin Trudeau & Sophie Gregoire Trudeau.

Why are boomers and generation x getting divorced at such a high rate? These generations challenge and reject stereotypes about aging. Boomers and Gen X are athletes, artists, activists, explorers, and leaders and they don’t want to age in unhappy marriages. Collaborative divorce appeals to boomers and gen xers because they would rather use their discretionary income on technology, fitness, travel, and experiences instead of on lawyers.

Custody issues, parenting plans, and child support are often the most common issues when younger people divorce. In Empty Nest Divorces, the most common issues are dividing debts and assets, dividing retirement benefits, spousal maintenance (alimony), and health insurance and medical expenses, all of which can be dealt with very effectively and affordably using collaborative divorce techniques.

I strongly believe that collaborative divorce is an excellent alternative to traditional divorce. In my experience, collaborative divorce is more affordable, faster, and less stressful than traditional divorce.
